User Agreement and Terms & Conditions

This User Agreement and Terms & Conditions governs your use of the MISS UR STOP mobile application, website, services, features, alerts, notifications, graphics, images, logos, and related content collectively referred to as the “App.”

By checking the box stating “I have read and agree to the Terms and Conditions”, you confirm that you have read, understood, and agreed to be legally bound by this Agreement.

You will not be permitted to enter or use the App unless you accept this Agreement.

1. Acceptance of Terms

By downloading, accessing, opening, or using the MISS UR STOP App, you agree to all terms contained in this Agreement.

If you do not agree with these terms, you must not use the App.

Human Legacy LLC reserves the right to update, revise, or modify this Agreement at any time. Continued use of the App after changes are posted means you accept the updated terms.

2. Informational Purposes Only

The MISS UR STOP App is provided for informational and convenience purposes only.

The App is designed to assist users by providing station alerts, train route information, scheduling information, estimated arrival information, and related notifications. However, the App is not intended to replace your own attention, judgment, planning, or responsibility while traveling.

You are solely responsible for monitoring your trip, surroundings, train stops, transfers, schedules, announcements, service changes, and destination.

3. No Guarantee of Accuracy

Human Legacy LLC does not guarantee that the scheduling, tracking, station alert, route, location, train movement, or notification features of the App will be accurate, complete, current, uninterrupted, or error-free.

Transit information may be delayed, unavailable, incorrect, incomplete, changed, or interrupted at any time.

By using the App, you understand and agree that:

• Train arrival and departure times may be inaccurate.
• Alerts may be delayed or may not occur.
• Location tracking may not function properly.
• Subway service may change without notice.
• Internet, GPS, cellular, device, or API issues may affect App performance.
• The App may fail to notify you before reaching your selected station.

4. No Liability for Travel Consequences

Human Legacy LLC, its owners, employees, contractors, representatives, affiliates, developers, and agents shall not be responsible or liable for any consequences resulting from your use of, reliance on, or inability to use the App.

This includes, but is not limited to:

• Missing a train
• Missing a subway stop
• Missing a bus, train, flight, or other connection
• Being late to work, school, appointments, events, meetings, or obligations
• Loss of money, income, opportunity, or employment
• Travel delays
• Personal inconvenience
• Service disruptions
• Missed reservations
• Any other direct, indirect, incidental, or consequential damages

You agree that you use the App entirely at your own risk.

5. Relationship to the New York City MTA

The MISS UR STOP App is independently owned and operated by Human Legacy LLC.

The New York City Metropolitan Transportation Authority, also known as the MTA, does not operate, own, sponsor, endorse, partner with, approve, support, or control the MISS UR STOP App.

Nothing in the App should be interpreted as creating any official relationship between Human Legacy LLC and the MTA.

Any references to the New York City subway system, train lines, train numbers, subway stations, maps, schedules, service data, or other transit-related information are provided only for user convenience and informational purposes.

6. MTA API Feeds and Third-Party Data

The tracking, scheduling, route, and service features of the App may rely on publicly available API feeds, data feeds, or other information sources provided by or associated with the New York City MTA.

Human Legacy LLC does not control the availability, accuracy, reliability, formatting, timing, or continued operation of these feeds.

You understand and agree that:

• API feeds may be delayed, interrupted, inaccurate, or unavailable.
• MTA data access may be suspended, modified, restricted, or discontinued at any time.
• Human Legacy LLC cannot guarantee that tracking or schedule features will always work.
• Service changes, emergencies, maintenance, signal issues, reroutes, or system delays may affect App performance.

Human Legacy LLC shall not be liable for any loss, delay, missed stop, missed connection, or other consequence caused by unavailable, inaccurate, delayed, or discontinued MTA data.

7. User Responsibility

You are responsible for your own travel decisions and personal safety.

While using the App, you agree to:

• Pay attention to your surroundings.
• Follow all MTA rules and regulations.
• Listen for official train and station announcements.
• Check official MTA sources when necessary.
• Use the App only as a supplemental tool.
• Avoid relying solely on the App for time-sensitive travel.

You should not use the App in any way that distracts you from safely entering, exiting, riding, or navigating public transportation.

8. Privacy and Security

Human Legacy LLC values user privacy and will make reasonable efforts to protect the privacy and security of users and devices using the App.

However, no mobile application, internet service, device communication, API connection, or digital system can be guaranteed to be completely secure.

By using the App, you understand and agree that Human Legacy LLC cannot guarantee protection against all unauthorized access, hacking, data interception, technical failure, malware, device compromise, third-party access, or other privacy or security breaches.

Human Legacy LLC, its owners, employees, contractors, representatives, affiliates, developers, and agents shall not be held liable for any privacy or security breach, data loss, unauthorized access, device issue, or damage that may occur as a result of using the App.

9. Device Permissions and Location Services

The App may require access to certain device features, including but not limited to location services, notifications, internet access, and device settings.

You are responsible for granting, denying, enabling, or disabling permissions on your device.

The App may not function correctly if permissions are denied, disabled, restricted, interrupted, or unavailable.

Human Legacy LLC is not responsible for missed alerts, tracking errors, or App failure caused by device settings, low battery, disabled GPS, disabled notifications, poor signal, limited internet access, operating system issues, or user-controlled permissions.

10. Intellectual Property of Human Legacy LLC

The MISS UR STOP App, name, original logo, graphics, designs, interface, layout, characters, images, text, branding, software, app concept, and related content created by or for Human Legacy LLC are the property of Human Legacy LLC unless otherwise stated.

You may not copy, reproduce, alter, modify, sell, resell, distribute, license, reverse engineer, exploit, or use any part of the App, its images, logo, design, or content for commercial or unauthorized purposes.

Unauthorized use of Human Legacy LLC’s intellectual property is strictly prohibited.

11. MTA Intellectual Property

Certain train numbers, train line symbols, subway maps, route information, station names, transit symbols, images, schedules, service information, and related transportation materials may belong to or be controlled by the New York City MTA or other authorized public transit entities.

Any use of MTA-related train numbers, maps, icons, images, service data, route identifiers, or transportation information is subject to the applicable rules, regulations, terms, licenses, and policies of the New York City MTA.

Human Legacy LLC does not claim ownership over official MTA intellectual property.

Users may not copy, misuse, alter, resell, or commercially exploit MTA-owned or MTA-controlled materials through the MISS UR STOP App.

12. Prohibited Use

You agree not to use the App to:

• Violate any law, regulation, or MTA rule.
• Copy, sell, or redistribute App content.
• Misrepresent the App as an official MTA product.
• Interfere with the App’s operation.
• Attempt to hack, reverse engineer, or damage the App.
• Use the App for unlawful, unsafe, or abusive purposes.
• Remove, alter, or obscure any ownership, copyright, trademark, or disclaimer notices.

13. No Warranty

The App is provided on an “as is” and “as available” basis.

Human Legacy LLC makes no warranties, promises, or guarantees of any kind, whether express or implied, including but not limited to warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, uninterrupted operation, or non-infringement.

You agree that your use of the App is at your sole risk.

14. Limitation of Liability

To the fullest extent permitted by law, Human Legacy LLC, its owners, employees, contractors, representatives, affiliates, developers, and agents shall not be liable for any direct, indirect, incidental, special, punitive, consequential, or financial damages arising from or related to your use of the App.

This includes damages related to missed stops, missed trains, delays, incorrect data, failed alerts, device problems, security issues, privacy breaches, lost opportunities, lost income, or any other consequence connected to the App.

15. Indemnification

You agree to defend, indemnify, and hold harmless Human Legacy LLC, its owners, employees, contractors, representatives, affiliates, developers, and agents from any claims, damages, losses, liabilities, costs, or expenses arising out of your use of the App, your violation of this Agreement, your misuse of App content, or your violation of any third-party rights or transit rules.

16. App Availability

Human Legacy LLC may update, suspend, restrict, discontinue, or terminate the App, or any part of the App, at any time without notice.

Human Legacy LLC is not responsible if the App becomes unavailable, interrupted, delayed, modified, or discontinued.

17. User Agreement Checkbox Requirement

Before using the MISS UR STOP App, each user must check a box confirming:

“I have read, understood, and agree to the MISS UR STOP App Terms and Conditions and User Agreement.”

By checking this box, you acknowledge that:

• You understand the App is for informational purposes only.
• You understand Human Legacy LLC is not responsible for travel outcomes.
• You understand the App is not operated, sponsored, or supported by the MTA.
• You understand tracking and scheduling information may be inaccurate or unavailable.
• You agree to use the App at your own risk.
• You agree to all terms stated in this Agreement.

If you do not check the agreement box, you will not be allowed to enter or use the App.

18. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of New York, without regard to conflict of law principles.

Any disputes arising from or related to this Agreement or the use of the App shall be handled in the appropriate courts located in the State of New York, unless otherwise required by law.

20. Final Acknowledgment

By checking the agreement box and using the MISS UR STOP App, you confirm that you have read this Agreement, understand it, and agree to be bound by its terms.

You also confirm that you understand the MISS UR STOP App is an independent informational tool and that Human Legacy LLC shall not be responsible for missed stops, missed trains, travel delays, missed connections, late arrivals, privacy issues, security breaches, inaccurate information, unavailable data, or any other consequence resulting from use of the App.
