User Agreement and Terms of Use

Personal Wellness App by Human Legacy LLC

This User Agreement and Terms of Use (“Agreement”) governs your access to and use of the Heal Wellness Companion App (“App”), created, owned, and operated by Human Legacy LLC (“Company,” “we,” “us,” or “our”).

Heal provides self-guided wellness, reflection, organization, and calming activities. Heal is not therapy, medical advice, crisis care, diagnosis, treatment, or a substitute for a licensed mental health professional.

⚠️ If you are in immediate danger, experiencing a medical emergency, or having thoughts of self-harm, call emergency services or contact a crisis hotline immediately. Do not rely on this app for emergency support.

By downloading, accessing, creating an account for, or using the App, you agree to be bound by this Agreement. If you do not agree with these terms, you should not download, access, or use the App.

1. Use of the App at Your Own Risk

You understand and agree that you are downloading, accessing, and using the App voluntarily and entirely at your own risk.

Human Legacy LLC does not guarantee any specific mental, emotional, behavioral, medical, personal, or wellness outcome from using the App. You acknowledge that any decisions, actions, behaviors, or consequences resulting from your use of the App are solely your responsibility.

Human Legacy LLC shall not be held responsible for any results, outcomes, damages, injuries, losses, emotional distress, personal decisions, or consequences arising from your use of, reliance on, or inability to use the App.

2. Not a Substitute for Professional Mental Health Care

The App is intended to provide general mental wellness support, reflection, engagement, journaling, prompts, emotional check-ins, or related wellness features.

The App is not a substitute for therapy, counseling, medical treatment, psychiatric care, crisis support, diagnosis, or advice from a trained professional.

You are strongly encouraged to seek support from a licensed therapist, counselor, psychologist, psychiatrist, physician, mental health professional, mental health organization, health support organization, crisis service, or support group as needed.

If you are experiencing a mental health emergency, thoughts of self-harm, thoughts of harming others, or any crisis situation, you should immediately contact emergency services, a crisis hotline, or a qualified mental health professional.

3. No Medical or Therapeutic Relationship

Use of the App does not create a doctor-patient, therapist-client, counselor-client, or other professional healthcare relationship between you and Human Legacy LLC.

Human Legacy LLC does not provide medical advice, mental health diagnosis, therapy, treatment plans, emergency intervention, or clinical care through the App.

Any information, prompts, content, responses, suggestions, or features provided through the App are for general informational and wellness purposes only.

4. User Responsibility

You are solely responsible for how you use the App and how you interpret or act upon any content, prompts, responses, exercises, tools, or information provided through the App.

You agree not to rely on the App as your only source of mental health support. You also agree that you are responsible for seeking professional help when appropriate.

By using the App, you acknowledge that Human Legacy LLC is not responsible for monitoring your mental health, emotional condition, safety, or well-being.

5. Privacy and Security

Human Legacy LLC considers user privacy to be one of its most important priorities.

To reduce the sensitivity of health-related data, the App does not store drug names or dosage information. Daily care reminders use only user-defined labels (such as “Morning” or “Bedtime”), which means no specific medication details are recorded or retained.

Human Legacy LLC makes reasonable efforts to keep any information entered into the App as secure as possible and to protect user privacy through appropriate safeguards, systems, and procedures.

However, you understand and agree that no digital system, mobile application, server, database, internet transmission, or electronic storage method can be guaranteed to be completely secure.

Human Legacy LLC cannot guarantee that information entered into or transmitted through the App will never be accessed, obtained, intercepted, disclosed, altered, or used by unauthorized third parties or outside sources.

By using the App, you acknowledge and accept these risks.

6. No Guarantee Against Unauthorized Access

While Human Legacy LLC makes efforts to protect user information, we cannot guarantee against any action by hackers, unauthorized users, third-party platforms, service providers, internet providers, device vulnerabilities, malware, government requests, legal processes, technical failures, or any other outside source that may result in information being accessed, obtained, disclosed, altered, or lost.

You agree that Human Legacy LLC shall not be held liable for any damages, losses, claims, emotional distress, reputational harm, privacy-related harm, or consequences resulting from unauthorized access to or use of information connected to your use of the App.

7. Limitation of Liability

To the fullest extent permitted by law, Human Legacy LLC, its owners, officers, employees, contractors, partners, developers, affiliates, agents, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, emotional, personal, financial, medical, psychological, or other damages arising out of or related to:

• Your use of the App; • Your inability to use the App; • Any reliance on information, prompts, responses, or content provided by the App; • Any emotional, mental, physical, personal, or behavioral outcome connected to use of the App; • Any unauthorized access to or disclosure of user information; • Any technical failure, data loss, interruption, error, or security breach; • Any action or decision taken by you based on use of the App.

By accepting this Agreement, you agree that Human Legacy LLC will not be held liable for any damage, harm, loss, injury, or consequence resulting from your usage of the App.

8. No Warranties

The App is provided on an “as is” and “as available” basis.

Human Legacy LLC makes no warranties or guarantees of any kind, express or implied, regarding the App, including but not limited to warranties of accuracy, reliability, availability, security, fitness for a particular purpose, usefulness, mental health benefit, or uninterrupted operation.

Human Legacy LLC does not guarantee that the App will meet your needs, improve your mental health, prevent emotional distress, or produce any specific result.

9. User-Entered Information

You are responsible for the information you choose to enter into the App.

You should not enter information that you do not want stored, processed, transmitted, or potentially exposed through the normal risks of digital technology.

You agree that Human Legacy LLC is not responsible for the content, accuracy, completeness, sensitivity, or consequences of information you voluntarily provide through the App.

10. Third-Party Services

The App may use or connect with third-party services, platforms, hosting providers, analytics tools, artificial intelligence systems, payment processors, communication tools, or other outside technologies.

Human Legacy LLC is not responsible for the privacy practices, security practices, actions, omissions, failures, or policies of any third-party service provider.

Your use of third-party services may be subject to their own terms, conditions, and privacy policies.

11. Emergency Situations

The App is not designed or intended to provide emergency assistance.

If you believe you may hurt yourself, hurt another person, or are experiencing a medical, emotional, or mental health emergency, you should immediately call emergency services or contact a crisis support service in your area.

Do not rely on the App for emergency support, crisis intervention, or urgent mental health care.

12. Acceptance of Risk and Release of Liability

By downloading, accessing, or using the App, you knowingly and voluntarily accept all risks associated with use of the App.

You agree to release, waive, and hold harmless Human Legacy LLC from any and all claims, liabilities, damages, losses, costs, or expenses arising from or related to your use of the App, to the fullest extent permitted by law.

You further agree that Human Legacy LLC shall not be responsible for any results, consequences, damages, or harm resulting from your use of the App.

13. Changes to This Agreement

Human Legacy LLC may update or modify this Agreement at any time. Any changes will become effective when posted in the App or otherwise made available to users.

Your continued use of the App after changes are posted means you accept the updated Agreement.

15. User Acknowledgment

By selecting “I Agree,” creating an account, downloading, accessing, or using the App, you acknowledge that:

• You have read and understood this Agreement; • You are using the App at your own risk; • The App is not a substitute for professional mental health care; • You are encouraged to seek help from trained mental health professionals or support organizations; • Human Legacy LLC makes reasonable efforts to protect user privacy and information; • Human Legacy LLC cannot guarantee complete security against unauthorized access or outside sources; • Human Legacy LLC shall not be held liable for damages, harm, loss, or consequences resulting from your use of the App.

Privacy Policy

This policy describes the information Heal handles to provide your account, wellness tools, and reminders, and the choices available to you.

Account and sign-in information

Heal uses Clerk to manage sign-in and may store your account identifier, email address, name, and profile image so it can identify your account and show your profile.

Information you add to Heal

Depending on which features you use, Heal stores journal text and mood ratings; appointment titles, provider names, dates and times, locations, and optional notes; custom affirmations; Daily Care labels, scheduled times, reminder settings, and completion records; saved doodle images; and activity progress such as garden stages and reflection counts. Heal does not ask for or store medication names or dosages. Use general Daily Care labels such as “Morning” or “Bedtime.”

Notifications and device information

If you enable device notifications, Heal stores the push subscription needed to deliver them, including a device-specific push address and encryption keys, your time zone, and browser user-agent information. Your browser or device push service processes the notification so it can reach your device. Notification text is kept general and does not include your appointment or Daily Care details. You can decline permission or turn notifications off at any time.

Information stored on your device

Peblo moments you choose to save and your agreement-accepted preference are stored in this browser’s local storage rather than synchronized to your Heal account. Peblo moments are available only in that browser on that device unless you separately preserve them.

How information is used and shared

Heal uses information to provide the features you choose, synchronize your account, deliver reminders you enable, and maintain service security and reliability. Sign-in is provided by Clerk; hosting, database, and device push providers process information needed to operate those services. Heal does not sell your personal information. Technical service logs may record request paths, response status, and timing.

Your choices and deletion

You may leave optional information out, remove entries where a delete control is provided, and decline or turn off device notifications in Heal or your device settings. You can permanently delete your Heal account and associated account data from the account menu; this also signs you out. Account deletion does not clear Peblo moments or the agreement preference saved in this browser. Delete Peblo moments in Peblo or clear Heal’s site data in your browser to remove local information. You can contact support with privacy questions.
